New Mexico is a “one-bite” state, which means that if a dog bites you and has never bitten or acted aggressive to anyone before, the owner would not be expected to have knowledge that the dog was dangerous and so may not be held liable. Essentially, this gives most dogs one free pass.
However, New Mexico does have a dangerous breed law. If you own a dog that is known as a dangerous breed, such as a pit bull, Doberman or Rottweiler, the dog and the owner do not get a “free” bite. In these situations, the owner can be held financially liable the very first time the dog bites someone.
